Summary Release from Administration Form Assistant
This interview will help you fill out the forms you need to file for a summary release from administration in probate court in Ohio. Summary release from administration lets you skip “full administration” from the probate court.
There are two cases where you can apply for summary release from administration:
- You are the surviving spouse of the deceased person. To be eligible, the surviving spouse must be entitled to all of the "family allowance." You are not eligible if your spouse left behind minor children who are not also your children. The value of the estate must not exceed $40,000 plus up to $5,000 in funeral expenses paid or owed by the surviving spouse.
- You paid for the deceased person’s funeral. To be eligible, you must pay or be obligated in writing to pay the funeral and burial expenses. The value of the estate can't be more than the total cost of the funeral or $5,000 (whichever is lower).

What what kind of case is this interview designed for?
This interview is not designed to assist with all possible summary release from administration cases. This interview is designed for cases where:
- If there is a surviving spouse, the applicant is the surviving spouse and the surviving spouse is the parent of all of the decedent's children
- Either there is no will, or there is a will that leaves 100% of the estate to the surviving spouse
